USE OF AR IS SUBJECT TO THE FOLLOWING TERMS & CONDITIONS. BY REGISTERING FOR YOUR FREE WEB SITE AND ACCEPTING REFERRED LEADS, YOU AGREE TO BE BOUND BY THESE TERMS & CONDITIONS. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT USE THE SITE.
RULES. While building and using your free web site, you may not: post, transmit or otherwise distribute information constituting or encouraging conduct that would constitute a criminal offense or give rise to civil liability, or otherwise use the AR Site in a manner which is contrary to law or would serve to restrict or inhibit any other user from using or enjoying the AR Site or the Internet; post or transmit any information or software which contains a virus, cancelbot, trojan horse, worm or other harmful or disruptive component; upload, post, publish, transmit, reproduce, or distribute in any way, information, software or other material obtained through the AR Site which is protected by copyright, or other intellectual property right, or derivative works with respect hereto, without obtaining permission of the copyright owner or holder of such right. User is solely responsible for the content, accuracy of and timely updating of all information on the user’s site.
By using and being registered with Agents Referrals you warrant that: you are a licensed real estate professional in full compliance with all applicable laws and regulations in your jurisdiction; you have permission, if necessary, from your broker if to participate in this program; are of legal age to enter in to a binding contract; you will use the information received for real estate purposes only and will not sell or distribute client information without prior written consent of the client and AR; as an AR agent, you are not allowed to register or represent your self as a buyer or seller on the site even if your intent is to buy or sell property.
PAYMENT OF REFERRAL FEES. Referral fees are due upon completion of any transaction that involves any referral that you receive through AR. The referral fee is 25% of the gross referred side commission calculated on a minimum of 2% prior to any split between the real estate professional and his or her broker, or allocation of a payment to another party. The following is provided for example only, in an attempt to clarify when referral fees are due.
Example 1) You receive a seller lead and obtain a listing at 6%, with 3% offered to the buyer agent, and another agent brings the buyer. Result: Upon closing, 25% of the 3% seller commission is due to AR.
Example 2) You receive a seller lead and, in addition to handling the sale of their home, you help the seller find their new home as their buyer's agent, for which you receive a 3% commission. Result: Upon closing, an in addition to any fees due from the sale of the client's home, 25% of the 3% commission earned as a buyer agent is due to FHRE.
A "Referral" is any person, home buyer or seller who is introduced, sent or referred to you
AGENT TERMINATION OF RELATIONSHIP. If at any time you choose to no longer be a member of FHRE, simply email us at one of the contact emails provided on the site, and you will be removed from the network.
AR TERMINATION OF RELATIONSHIP. While it is the intention of AR to enjoy a lasting relationship with all of our member agents, FHRE is under no obligation to continue to include an agent in the AR network. AR may terminate your account at any time for any reason, including (but not limited to) poor feedback of your service from referred leads, an unacceptable number of provided leads without any closings, and if it is discovered that you closed an AR referral and did not send the due referral fees.
OVERSIGHT. FHRE will monitor the AR web site to ensure compliance with all applicable laws and regulations that relate to the site. FHRE will disclose only information to satisfy any law, regulation or government request to operate the site or protect itself or users of the site. FHRE will not disclose any private electronic information unless required by law. FHRE reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of this Agreement.
ACCOUNT / PASSWORDS. You are responsible for maintaining and keeping confidential your user login and password and are solely responsible for activity that occurs under your login and password.
PRIVACY. It is understood the free web sites provided by AR to you are on the internet, advertised and widely viewed. AR can not guarantee the privacy of information posted on the sites. These web sites are not intended for the communication of confidential material and any such use will be the sole responsibility of the user and AR/FHRE are specifically relieved of any liability relating to this.
LIMITATION OF LIABILITY. AR websites are a free service provided to you. FHRE takes no responsibility for the accuracy or validity of any claims or statements contained in the documents and related graphics or software on the AR Site All such software programs, documents and related graphics are provided without warranty of any kind. In no event shall FHRE be liable for any damages whatsoever, including special, indirect or consequential damages, arising out of or in connection with the use or performance of information available from the service.
RECOURSE. If you are dissatisfied with the AR Site or with any terms, conditions, rules, policies, guidelines, or practices of FHRE in operating the AR Site, your sole and exclusive remedy is to discontinue using the AR Site.
INDEMNITY. You agree to defend, indemnify and hold FHRE and its affiliate and related companies harmless from any and all liabilities, costs and expenses, including reasonable attorneys' fees, related to any Violation of this Agreement by you or users of your account, or in connection with the use of the AR Site or the Internet or the placement or transmission of any message, information, software or other materials on the AR Site or on the Internet by you or users of your account.
MISCELLANEOUS. This Agreement, including any and all documents referenced herein, constitute the entire agreement between AgentsReferrals.net and you pertaining to the subject matter hereof. Federal Homes and Real Estate’s failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provisions or right. If any of the provisions contained in this Agreement be determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions contained herein. This Agreement shall be governed by and construed in accordance with the laws of the state of Washington and the federal laws of the United States of America applicable therein.
